Nominet get involved

Whilst waiting for a reply from the Editor of the Daily Mail (by the way Ed, we're still waiting....) the postman delivers a bulky letter on the doorstep one sunny saturday morning.

It's from Nominet.

It contains a copy of a letter from the other FSA. They start off saying what big boys they are, how much bigger they are going to become and how they have a statutory duty to protect etc... They also say they wish to call in Nominet's dispute resolution service over the issue because:

    "We are concerned that, given our reputation and goodwill, members of the public will become confused by the use of the domain name by Findlay Steele Associates and ourselves to our and the public's detriment. To this end, we understand that your registration rules ..... entitle you to cancel a registration or suspend delegation ..... if that name is being used in a manner likely to cause confusion to internet users, where you are informed that legal action has been commenced regarding use of the name or where you are of the opinion that one of the last two events is likely to occur.

    We should say straight away that if the dispute resolution procedure which you run and host is not successful then we shall have to consider taking legal proceedings in relation to the use of the domain name via an action for passing off. However we do not do so now because we believe that we (that is ourselves, yourselves and Findlay Steele Associates) are under an obligation to try to resolve this matter in a non-litigious way, via yourselves and you
    [sic] Dispute Resolution Service"

The letter is signed by a gentleman lawyer of their very own General Counsel's Division.
